Bankruptcy: Bankruptcy is a great tool to stop debt collection and eliminate debt. This is a right afforded to individuals and businesses under federal law, and these laws offer tremendous protections. Filing for bankruptcy relief will stop lawsuits and wage garnishments. The Bankruptcy Code can be a tremendous asset to those facing financial hardships.
In a Chapter 7 filing, one can eliminate credit cards, medical bills, personal loans, and many other obligations while (in most cases) protecting your assets. In Chapter 13 reorganizations, you can create a repayment plan to pay some or all of your debt, catch up on your mortgage arrears, and save your house from foreclosure.
Alternatives to Bankruptcy: Bankruptcy is not always the answer for everyone, and we provide alternatives. Bankruptcy may put assets at risk or impact your ability to get credit after your case concludes. Small businesses can continue operating while avoiding a cost-prohibitive Chapter 11 business bankruptcy. Often it’s best to work with the creditors directly. We provide the strength and negotiation to help get you favorable settlements or repayment options to quickly eliminate your debt.
Foreclosure Defense: Your home is your most valuable asset. If you are struggling to make your mortgage payments and fall behind, your bank can exercise its right to foreclose. Lenders have to follow very specific requirements in a foreclosure action and sometimes get sloppy. We work with homeowners to preserve their rights and join their fight to save their homes. That fight may lead to a loan modification or other favorable outcomes. Extended litigation may be necessary to protect you and hold the bank accountable.
Attorney Support: In addition to our work with individuals and small businesses, Matthew D. Zimmelman, Esq. also assists fellow attorneys and their practices. He provides support on bankruptcy and foreclosure matters including drafting motions, litigation, fee applications, appearances, and general case review. Mr. Zimmelman can be a resource for other attorneys. He works with solo practitioners and small firms on a per diem or of counsel basis.
